US ITC Overturns US Commerce Department Ruling; Will Not Impose Countervailing and Anti-Dumping Duties on Imported Active Anode Materials from China

On March 12th local time, the U.S. International Trade Commission (ITC) issued a statement saying that imported active anode materials from China do not pose a substantial barrier to the establishment of related U.S. industries. The statement said that based on the commission’s negative determination, the U.S. Department of Commerce will not impose anti-dumping or countervailing duties on such Chinese imports.

Previously, on February 11th, the U.S. Department of Commerce announced a final affirmative determination of anti-dumping duties on imported active anode materials from China, with dumping margins of 93.50% for Chinese producers/exporters with separate rates and 102.72% for Chinese-wide rates. It also made a final affirmative determination of countervailing duties, with subsidy rates ranging from 66.82% to 66.86%.
