Guangzhou Internet Court: There are disputes over the value determination of Crypto Assets, and relevant regulations need to be improved urgently.
According to Wu, the Guangzhou Internet Court held a press conference on April 23 to analyze the civil judicial protection paths and typical cases of “network virtual property” and released the “Research and Analysis Report on the Legal Nature of Network Virtual Property and Civil Judicial Protection Paths.” The court categorizes network virtual property into reality mapping types (such as online stores) and network construction types (such as game props, NFT, Crypto Assets), proposing that constructed virtual property has both property and debt characteristics: firstly, it is the object of the creditor relationship between operators and users, and secondly, it is the object of the property relationship between users, but is limited by user agreements and the like. The Guangzhou Internet Court pointed out that Crypto Assets, as network construction-type virtual property, are prone to financial risks due to disputes over value recognition, and relevant legal norms urgently need improvement.
